LevelSend

Terms of use

Last updated: 18 October 2026

These terms govern the use of LevelSend ("the app"), an email marketing app for Shopify stores published by Elektraset, s.r.o. ("we", "us"). By installing the app, the merchant ("you") accepts these terms. Contact: help@elektraset.com.

1. The service

LevelSend sends the marketing emails you design (campaigns and the welcome, abandoned-checkout and post-purchase flows) to your subscribers. It also:

  • syncs customers, consent and products from your Shopify store;
  • provides signup forms;
  • enforces a monthly email cap;
  • exports your data in open formats.

2. Plans, billing and the price lock

  • Billing. Plans are billed by Shopify every 30 days in USD, according to the plan you approve in your Shopify admin. Paid plans start with the free trial shown on the plan.
  • Flat price, no overage. Each plan includes a number of emails per calendar month. Contacts are unlimited. When the month's emails are used, or your own lower cap is reached, LevelSend pauses sending until the next month or until you raise the cap or change the plan. We never charge for emails above your plan, and we never move you to another plan without your approval in Shopify.
  • Price lock. The monthly price of the paid plan you choose is locked for 24 months from the day you approve it. During that time we will not raise the price of that plan for your store. If we change our public prices, the change applies only to stores that choose a plan after the change, or to your store after the lock ends and only if you approve the new price in Shopify. Shopify requires your approval for any new or changed app charge.
  • Changing or cancelling. You can change plans or return to the Free plan at any time in the app. Uninstalling the app cancels the subscription. Shopify handles refunds according to its rules. We do not charge cancellation fees.
  • Taxes. Prices exclude taxes that Shopify may add.

3. Your responsibilities

  • Consent. You email only people who gave you consent to marketing emails, as required by the laws that apply to you and your subscribers (for example GDPR and ePrivacy in the EU, CAN-SPAM in the USA, CASL in Canada). Do not import lists you bought, rented or scraped.
  • Accurate details. You keep your store name, postal address and reply-to address accurate. LevelSend adds them, with an unsubscribe link, to every marketing email.
  • Lawful content. You do not send unlawful, deceptive, infringing, adult, hateful or malicious content, phishing or malware, and you do not try to hide the sender.
  • Complaints and bounces. You keep complaint and bounce rates low. If a store's sending threatens deliverability for others (for example spam complaint rates above 0.3 %), we may pause its sending and contact you.

4. Your data

  • You own your data. We process it only to provide the app, as described in our Privacy policy, which forms part of these terms (it acts as our data processing terms for the personal data of your customers).
  • You can export your subscribers, consent records, templates and flows at any time.

5. Availability and deliverability

  • We work to keep the app available and to deliver your emails promptly.
  • Email delivery depends on recipients' mail providers, so we cannot guarantee inbox placement, open rates or sales.
  • Planned maintenance is kept short.

6. Liability

  • The app is provided "as is" to the extent the law allows.
  • Our total liability for any claim in a 12-month period is limited to the fees you paid us for the app in that period.
  • We are not liable for indirect or consequential losses, such as lost profits.
  • Nothing in these terms limits liability that cannot be limited by law.

7. Suspension and termination

  • You can stop using the app at any time by uninstalling it.
  • We may suspend sending for a store that breaks section 3 or harms the service for others. We tell you why and give you a chance to fix it unless the harm is urgent.
  • We may end the service with 60 days' notice. During that time your data stays exportable.

8. Changes to these terms

  • We may update these terms and post the new version here.
  • Material changes are announced to installed stores at least 30 days in advance.
  • Changes never shorten a price lock that is already running.

9. Law

These terms are governed by the laws of the Slovak Republic. Mandatory consumer or merchant protection laws of your country still apply.
